1. Agreement to Terms
By accessing or using the services provided by xHireAI ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use our services.
2. Services
xHireAI provides AI-powered voice, chat, and SMS agents for businesses. Our services include but are not limited to:
- AI voice agents for 24/7 call answering and appointment booking
- AI chat agents for website lead capture and customer support
- AI SMS agents for automated follow-ups and lead qualification
- Industry-specific agent templates (20+ verticals)
- Embeddable website widgets
- Real-time analytics dashboard
3. Pricing & Payment
All pricing is listed on our website. Subscriptions are billed monthly. You authorize recurring billing until you cancel. Payments are processed securely through Stripe. All plans include unlimited AI conversations with no per-message fees. All plans include unlimited AI conversations with no per-message fees. All infrastructure and AI compute costs are included in your flat monthly subscription. No hidden setup fees or third-party token costs.
4. Managed Infrastructure
xHireAI is a fully managed platform. We provision your dedicated phone numbers, handle all AI compute costs, and manage the underlying infrastructure. Unlike "Bring Your Own Key" platforms, xHireAI provides a turnkey solution with no external API accounts required from the user.
5. Cancellation
You may cancel your subscription at any time from your dashboard or by contacting us. Cancellations take effect at the end of the current billing period. No refunds are provided for partial months.
6. Acceptable Use
You agree not to use our services to:
- Send unsolicited spam or make illegal robo-calls
- Violate any applicable laws (including CAN-SPAM, TCPA, and A2P 10DLC regulations)
- Engage in fraudulent, deceptive, or illegal activity
- Impersonate a human without proper disclosure where legally required
- Process sensitive personal data (health, financial, legal) without appropriate safeguards
You are responsible for obtaining proper opt-in consent from all contacts before initiating AI-powered communications.
7. Data & Privacy
We take your data seriously. We do not sell your data to third parties. Please refer to our Privacy Policy and Data Processing Agreement for details on how we handle your information. Customer data is encrypted with AES-256 at rest and TLS 1.3 in transit.
8. Intellectual Property
xHireAI retains all rights to the platform, software, and underlying technology. You retain all rights to your business data, call transcripts, and chat logs. AI-generated content (agent responses) is owned by you but may not be used to train competing AI models.
9. Limitation of Liability
xHireAI is not liable for indirect, incidental, or consequential damages arising from use of our services. Our total liability shall not exceed the amount you paid us in the 3 months preceding the claim. We do not guarantee specific revenue outcomes, lead volumes, or appointment booking rates.
10. Uptime & Availability
We target 99.9% uptime for all services. In the event of planned maintenance, we will provide 24 hours' notice. Pro plan customers are covered by our SLA guarantee.
11. Changes to Terms
We may update these terms at any time. We'll notify you of material changes via email. Continued use of services after changes constitutes acceptance.
